As a buyer, can I replace my buyer’s agent even though we’re in the middle of Escrow?

April 11, 2011

Things have been going downhill with our buyer’s agent ever since we started negotiations. We feel as though they’re representing the seller’s best interests, not our own, and it’s resulting in headaches, frustration, and stress that we no longer want to be dealing with as first-time home buyers. What are our options for replacing them in the state of California? We’re already in Escrow right now, but we do not have a signed contract with our agent.

You have a contract, otherwise there would not be any escrow account opened.

Your contract is not with the agent though, it is with the broker. Contact the broker and ask to be reassigned, this is not a big deal. The broker knows many that he hires will be flakes, this is how he finds out.

You will have a new agent or the broker will take over themselves. Do not sweat this, it is not a big deal.

However, if you bring in another agent from a different broker the first agent will get their commission, you will have to pay it in order to close.
